1. What Outfluence does

Outfluence is a Shopify app that researches your store’s customers using public sources, licensed data providers and AI, and shows you profiles, alerts and analytics about them. Our Privacy Policy describes the data involved and the providers we use.

Research results are estimates. They come from public and third-party sources and from AI that can be wrong, out of date or about a different person with the same name. Confidence and sources are shown where we have them. Check anything important before you rely on it.

2. Plans, billing and usage

• Plans, prices and monthly allowances are shown in the app under Settings, then Billing. You choose and pay for a plan through Shopify, which bills you every 30 days. Our prices don’t include taxes.
• Each plan includes a number of new customers checked, and of full profiles, in each billing period. A customer counts once as a check; repeat orders and the Discovery scan at install don’t count. A full profile counts each time one runs, including deep research on a customer who already has a profile.
• On a paid plan, research continues past the allowances: each extra customer and each extra full profile is charged at your plan’s prices, through Shopify, with no monthly cap. To stop extra charges, cancel or change your plan. On the Free plan or a free trial, checks on new customers pause when you reach the allowance until the next period.
• You can upgrade, downgrade or cancel at any time from the app or by uninstalling it. Shopify handles proration and refunds under its billing rules; otherwise fees already charged aren’t refundable, except where the law requires.
• We may change prices or plans with at least 30 days’ notice. Changes take effect from your next billing period. The free plan and the Discovery scan are offered at our discretion and may change.

3. Your responsibilities

You’re responsible for how you use Outfluence and the information it gives you. You agree to:

• comply with the privacy, marketing, consumer protection and anti-discrimination laws that apply to you and your customers;
• tell your customers, in your own privacy policy, that you use service providers to learn about them, and have any legal basis or consent the law requires for that;
• keep access to the app to staff who need it, and keep your Shopify and Slack accounts secure.

4. Things you may not do

• No eligibility decisions. Don’t use Outfluence, or anything it shows you, to decide anyone’s eligibility for credit, employment, insurance, housing or tenancy, or for any other purpose covered by the Fair Credit Reporting Act or similar laws. Outfluence is not a consumer reporting agency and its profiles are not consumer reports.
• No harm to the people you research. Don’t use it to harass, stalk, threaten or discriminate against anyone; to contact a customer’s employer, family or associates about them; or to publish or expose information about them.
• Only your customers. Only research people who have bought from, or signed up with, your store.
• No resale. Don’t sell, license or give profiles or research to third parties, or use them to build a database for anyone else.
• Don’t try to get around plan limits, access other stores’ data, interfere with the service, or copy, reverse engineer or resell Outfluence.

5. Your data

Your store data and the profiles we create for you are yours. You give us permission to use them to provide and support Outfluence for you, as described in the Privacy Policy. We act as your service provider for your customers’ personal information, and we don’t sell it, share it with other stores or use it to train AI models. We may use aggregated, de-identified information, such as research costs and match rates, to run and improve Outfluence.

When you uninstall Outfluence, we delete your store’s data as described in the Privacy Policy. Messages already posted to your Slack workspace stay there under your control.

6. Other services

Outfluence works with Shopify, Slack and the data providers named in the Privacy Policy. Your use of Shopify and Slack is governed by their own terms, and we aren’t responsible for those services.

7. Our property

Outfluence, including its software, design and content, belongs to us and our licensors. These terms give you the right to use it while you’re subscribed; they don’t transfer ownership. If you send us feedback, we may use it without obligation to you.

8. Suspension and termination

You can stop using Outfluence at any time by uninstalling it. We may suspend or end your access if you break these terms, if payment fails, or if your use puts other people, other customers or the service at risk. Where reasonable, we’ll tell you first and give you a chance to fix the problem.

9. Disclaimers

Outfluence is provided “as is” and “as available”. To the extent the law allows, we disclaim all warranties, express or implied, including that research results are accurate, complete or current, and warranties of merchantability, fitness for a particular purpose and non-infringement. We don’t promise the service will be uninterrupted or error-free.

10. Limits on liability

To the extent the law allows, we won’t be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data. Our total liability for any claim relating to Outfluence is limited to the fees you paid us in the 12 months before the claim arose, or US$100 if that’s more.

11. Indemnity

You’ll defend and indemnify us against third-party claims arising from your use of Outfluence in breach of these terms or the law, including claims by your customers about how you used information about them.

12. Changes to these terms

We may update these terms. We’ll post the new version here with a new date, and tell you in the app or by email before significant changes take effect. Continuing to use Outfluence after that means you accept them.

13. General

These terms, with the Privacy Policy, are the whole agreement between us about Outfluence. If part of them can’t be enforced, the rest still applies. Not enforcing a term isn’t a waiver of it. You may not transfer these terms without our consent; we may transfer them as part of a merger, acquisition or sale of the business.
